AKHAROUB LLC ("AKHAROUB," "we," "us," or "our") collects information you provide directly to us and information collected automatically when you use our website and learning platform (together, the "Services").

1.1 Information you provide to us

• Account information: name, email address, password (stored in hashed form), country, and preferred learning language.
• Billing information: billing name, billing address, and subscription plan selected. Full card numbers are collected and stored directly by our payment processor, Stripe, Inc. — see Section 6.
• Communications: messages you send through our Contact Us form, Help Desk, live chat, or email, including any attachments.
• Learning content you submit: written exercises, recorded audio for pronunciation practice, and messages exchanged with tutors during live sessions.
• Application information: resumes, cover letters and portfolio links submitted through our Careers page or Affiliate Program application.

1.2 Information collected automatically

• Usage data: pages visited, lessons started/completed, session duration, click patterns and referring URLs.
• Device data: browser type and version, operating system, device identifiers, IP address and approximate location derived from IP address.
• Cookies and similar technologies: as described in our Cookie Policy.

2. How We Use Information

We use the information we collect to:

• Create and administer your account and deliver the Services you request;
• Process subscription payments, renewals, upgrades, downgrades and refunds;
• Personalize your learning path, including placement recommendations and progress tracking;
• Match you with tutors and schedule live conversation sessions;
• Send transactional communications (receipts, renewal notices, password resets, support replies);
• Send marketing communications where you have opted in, such as our newsletter, with an unsubscribe option in every email;
• Monitor, maintain and improve the security, performance and content of the Services;
• Detect, investigate and prevent fraud, abuse and violations of our Acceptable Use Policy or Terms of Service;
• Comply with legal obligations, including tax and accounting requirements.

3. Legal Basis for Processing

Where the EU/UK General Data Protection Regulation applies, we process personal data on the following legal bases:

• Performance of a contract — to create your account, deliver courses and process payments.
• Legitimate interests — to secure our platform, improve our Services, and communicate with you about your account, balanced against your rights and interests.
• Consent — for optional marketing communications and non-essential cookies, which you may withdraw at any time.
• Legal obligation — where processing is required to comply with tax, accounting or other applicable law.

4. How We Share Information

We do not sell your personal information. We share information only in the following circumstances:

• Service providers: vendors who perform services on our behalf, including payment processing (Stripe, Inc.), cloud hosting, email delivery, video-conferencing infrastructure for live sessions, and customer support tooling. These providers are contractually bound to use data only to provide services to us.
• Tutors: your first name, learning level, and relevant progress notes are shared with the tutor(s) assigned to your live sessions so they can prepare and personalize instruction.
• Business transfers: in connection with a merger, acquisition, financing, or sale of assets, information may be transferred as part of that transaction, subject to standard confidentiality arrangements.
• Legal requirements: where required to comply with a subpoena, court order, or other legal process, or to protect the rights, property or safety of AKHAROUB, our students, or the public.
• With your consent: for any other purpose disclosed to you at the time of collection, with your consent.

5. Cookies & Tracking

We use cookies and similar technologies to operate the Services, remember your preferences, and understand how the Services are used. Full detail on categories of cookies, their purposes, and how to manage your preferences is available in our Cookie Policy.

6. Payment Data

All subscription payments are processed by Stripe, Inc., a PCI-DSS Level 1 certified payment processor. When you enter payment card details at checkout, that information is transmitted directly to Stripe's secure servers. AKHAROUB does not receive or store your full card number, CVC, or full magnetic stripe/chip data. We retain only limited billing metadata necessary for our own accounting and customer support, such as the plan purchased, amount charged, transaction date, and a masked card identifier (e.g., "Visa ending 4242") provided to us by Stripe.

7. Data Retention

We retain personal information for as long as your account is active and for a reasonable period thereafter to comply with legal obligations, resolve disputes and enforce our agreements. As a general matter:

• Account and course-progress data is retained for the life of your account plus 24 months after closure, unless you request earlier deletion under Section 9.
• Billing records are retained for at least 7 years to comply with applicable tax and accounting law.
• Recorded live-session audio used for pronunciation feedback is retained for 12 months, then automatically deleted, unless you request earlier deletion.
• Support tickets and correspondence are retained for 3 years for quality and training purposes.

8. Data Security

We maintain administrative, technical and physical safeguards designed to protect personal information against unauthorized access, disclosure, alteration and destruction, including encryption of data in transit (TLS), hashed password storage, role-based access controls, and regular security review of our systems and vendors. No method of transmission or storage is 100% secure, and we cannot guarantee absolute security.

9. Your Privacy Rights

Depending on your location, you may have some or all of the following rights regarding your personal information:

• Access — request a copy of the personal information we hold about you;
• Correction — request that we correct inaccurate or incomplete information;
• Deletion — request that we delete your personal information, subject to legal retention requirements described in Section 7;
• Portability — request a copy of your data in a structured, machine-readable format;
• Objection / restriction — object to or request restriction of certain processing based on legitimate interests;
• Withdraw consent — withdraw consent for marketing or non-essential cookies at any time;
• Non-discrimination — we will not discriminate against you for exercising any of these rights.

To exercise any of these rights, email privacy@akharoub.com or use our Help Desk. We will respond within the timeframe required by applicable law (generally within 30 days). We may need to verify your identity before fulfilling certain requests.

10. International Data Transfers

AKHAROUB LLC is registered in the United States and our infrastructure providers operate data centers in multiple regions. If you access the Services from outside the United States, your information may be transferred to, stored, and processed in the United States or other countries where our service providers operate. Where required, we rely on appropriate safeguards such as Standard Contractual Clauses for such transfers.

11. Children's Privacy

The Services are intended for users aged 16 and older. We do not knowingly collect personal information from children under 16. Learners between the ages of 13 and 16 may use the Services only with the consent and active supervision of a parent or legal guardian, who is responsible for the learner's account. If we learn that we have collected personal information from a child under 13, we will delete that information promptly.

12. Changes to This Policy

We may update this Privacy Policy from time to time. If we make material changes, we will notify you by email and/or a prominent notice on our website prior to the change becoming effective. The "Effective" date at the top of this page indicates when this policy was last revised.

1. Acceptance of Terms

These Terms of Service ("Terms") form a binding agreement between you and AKHAROUB LLC ("AKHAROUB," "we," "us") governing your access to and use of the akharoub.com website, learning platform, mobile experiences, and related services (collectively, the "Services"). By creating an account, purchasing a subscription, or otherwise using the Services, you agree to be bound by these Terms, our Privacy Policy, our Refund Policy, our Cookie Policy, and our Acceptable Use Policy, each incorporated by reference. If you do not agree, do not use the Services.

2. Eligibility & Accounts

You must be at least 16 years old to create an account, or between 13 and 16 with the consent and supervision of a parent or legal guardian who agrees to these Terms on the learner's behalf. You agree to provide accurate registration information, keep your password confidential, and notify us promptly of any unauthorized use of your account. You are responsible for all activity that occurs under your account.

3. Description of Services

AKHAROUB provides structured online language learning programs, including self-paced lessons, live group conversation sessions, one-on-one tutor sessions on eligible plans, pronunciation coaching, downloadable learning materials, progress tracking, and an online placement assessment. Specific features available to you depend on your active subscription plan as described on our Pricing page.

4. Subscriptions, Fees & Billing

AKHAROUB offers the following subscription plans, billed in advance in U.S. dollars:

Payment is processed securely through Stripe, Inc. at the time of purchase and at each renewal. Prices are exclusive of applicable taxes, which will be calculated and added at checkout based on your billing location where required by law. We reserve the right to change subscription pricing; any price change will apply from your next renewal following at least 30 days' notice, and will never apply retroactively to a period you already paid for.

5. Cancellation & Auto-Renewal

Subscriptions renew automatically at the end of each billing cycle at the then-current price for your plan, unless cancelled before the renewal date. You may cancel at any time from Dashboard → Subscription → Cancel Plan, or by contacting our Help Desk. Cancellation stops future renewals; it does not automatically entitle you to a refund of the current billing period — refund eligibility is governed by our Refund Policy. You will retain access to paid features through the end of your current billing period.

6. Content & Intellectual Property

All course content, curriculum materials, video, audio, software, graphics, trademarks and the AKHAROUB name and logo are the property of AKHAROUB LLC or our licensors and are protected by intellectual property laws. Subject to your compliance with these Terms and an active subscription, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use course materials for your personal, non-commercial educational use. You may not copy, reproduce, distribute, publicly display, resell, or create derivative works from our content without prior written permission. Downloadable materials (PDFs, worksheets) are licensed for your personal use and may not be redistributed or shared outside your household.

Any written exercises, audio recordings, or other content you submit through the Services ("User Content") remains yours; you grant AKHAROUB a worldwide, royalty-free license to use, store and process User Content solely to provide and improve the Services, including sharing relevant content with your assigned tutors.

7. User Conduct

Your use of the Services is also governed by our Acceptable Use Policy, which prohibits, among other things, harassment of tutors or other students, sharing account credentials, circumventing payment, scraping or reselling course content, and uploading unlawful content. Violations may result in suspension or termination as described in Section 9.

8. Tutors & Live Sessions

Live conversation sessions and 1:1 tutor sessions are subject to scheduling availability. We ask that you provide at least 12 hours' notice to reschedule a 1:1 session; late cancellations or no-shows may count against your included session allotment for the billing period, as described in your Dashboard. Tutors are independent contractors or employees of AKHAROUB who have completed our training and background-check process; AKHAROUB is responsible for the quality assurance of sessions delivered through the platform.

9. Suspension & Termination

We may suspend or terminate your account, with or without notice, if we reasonably believe you have violated these Terms, our Acceptable Use Policy, or applicable law, or to protect the safety or integrity of the Services, other students, or our tutors. You may close your account at any time from your Account Settings. Sections of these Terms that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and governing law) will survive.

10. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. AKHAROUB DOES NOT GUARANTEE THAT ANY SPECIFIC LEARNER WILL ACHIEVE A PARTICULAR PROFICIENCY LEVEL, EXAM RESULT, OR TIMEFRAME, AS LANGUAGE ACQUISITION OUTCOMES DEPEND SUBSTANTIALLY ON INDIVIDUAL EFFORT, CONSISTENCY, AND APTITUDE. 11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AKHAROUB LLC AND ITS OFFICERS, EMPLOYEES, TUTORS AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID TO AKHAROUB IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless AKHAROUB LLC and its officers, employees and tutors from any claims, damages, liabilities and expenses (including reasonable attorneys' fees) arising out of your violation of these Terms, your User Content, or your misuse of the Services.

13. Governing Law & Disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Services will be resolved through binding arbitration on an individual basis in accordance with the rules of a recognized arbitration body, except that either party may bring an individual claim in small claims court. You and AKHAROUB each waive any right to a jury trial or to participate in a class action, to the extent permitted by applicable law. Consumers residing in the European Union or United Kingdom retain any non-waivable statutory rights available under their local consumer protection law.

14. Changes to These Terms

We may modify these Terms from time to time. Material changes will be notified by email and/or a notice on the Services at least 14 days before taking effect. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.

1. Overview

We want AKHAROUB to feel like an easy decision. This Refund Policy explains when and how you can request a refund for a subscription purchased on akharoub.com. This policy is part of, and should be read together with, our Terms of Service.

2. Refund Eligibility

You are eligible for a full refund of a new subscription purchase if all of the following are true:

• Your request is made within 14 calendar days of the original purchase date; and
• You have completed less than 20% of the lessons in your active course; and
• You have attended no more than one live conversation session or 1:1 tutor session.

Requests that meet these conditions are approved automatically. Requests outside these conditions are reviewed individually by our billing team, who may approve a full or partial refund at their discretion — for example, in cases of documented technical failure on our end, or extended illness supported by reasonable documentation.

2.1 Plan renewals

If a subscription renews automatically and you did not intend to renew, contact us within 7 days of the renewal charge and we will refund that renewal in full, provided you have not used any course content or attended any session during the new billing period.

3. How to Request a Refund

To request a refund, either:

1. Go to Dashboard → Subscription & Billing → Request Refund; or
2. Email billing@akharoub.com with your account email and order date; or
3. Submit a ticket through our Help Desk under "Billing & Subscriptions."

4. Processing Time

Approved refunds are issued to your original payment method through Stripe within 5–10 business days. Depending on your card issuer, it may take a few additional business days for the refund to appear on your statement. You will receive an email confirmation once the refund has been issued.

5. Automatic Renewals

All plans renew automatically at the end of their billing cycle unless cancelled beforehand. We send a renewal reminder email 5 days before each renewal. You can cancel anytime from your Dashboard to prevent the next renewal charge — see Section 5 of our Terms of Service.

6. Non-Refundable Items

The following are not eligible for a refund, except where required by applicable law:

• Subscription periods that have already been substantially used (20% or more of course content completed, or more than one live/1:1 session attended);
• Requests made more than 14 days after the original purchase or, for renewals, more than 7 days after the renewal charge;
• Missed live sessions where you did not provide the notice described in our Terms of Service;
• Promotional or discounted purchases explicitly marked as final sale at checkout.

7. Chargebacks

If you believe you were charged in error, please contact us first so we can resolve it directly — most billing issues are resolved within one business day. Initiating a chargeback with your card issuer without first contacting us may result in suspension of your account while the dispute is investigated. We provide transaction records to card issuers in response to legitimate chargeback inquiries.

8. Statutory Withdrawal Rights (EU/UK)

If you are a consumer located in the European Union or United Kingdom, you have a statutory right to withdraw from a digital-content purchase within 14 days without giving a reason, in accordance with applicable consumer protection law. By beginning to access course content immediately after purchase, you expressly consent to the immediate performance of the Services and acknowledge that this may affect your withdrawal right once the digital content has been fully accessed. Nothing in this Refund Policy limits any non-waivable statutory right you may have under the law of your country of residence.

1. Purpose

This Acceptable Use Policy ("AUP") describes conduct that is prohibited when using the AKHAROUB Services. It applies to all users, including students, tutors, affiliates and visitors, and forms part of our Terms of Service.

2. Prohibited Conduct

You may not use the Services to:

• Violate any applicable law or regulation;
• Harass, threaten, defame, or discriminate against any tutor, student or staff member on the basis of race, ethnicity, religion, gender, sexual orientation, disability, or nationality;
• Upload, transmit or share unlawful, obscene, hateful, or sexually explicit content;
• Impersonate any person or entity, or misrepresent your affiliation with AKHAROUB;
• Attempt to gain unauthorized access to any account, system or network related to the Services;
• Introduce viruses, malware, or other harmful code;
• Scrape, crawl, or use automated means to extract course content or data from the platform without our prior written consent;
• Interfere with or disrupt the integrity or performance of the Services, including live sessions for other students;
• Record, redistribute, or resell course content or live sessions without written permission.

3. Account Sharing & Resale

Subscriptions are for individual use only. Sharing your login credentials, allowing another person to use your account, or reselling access to course content is a violation of this AUP and our Terms of Service, and may result in suspension or termination without refund.

4. Live Session Conduct

Live conversation and 1:1 tutor sessions are a shared learning space. Participants are expected to be respectful, arrive on time, keep their camera/microphone functioning as reasonably required for the session type, and refrain from any conduct that would make the session unsafe or unwelcoming for others. Tutors may end a session early and report the incident if a participant violates this section.

5. Content Standards

Any written exercises, recordings, forum posts, or messages you submit must not contain plagiarized material submitted as your own coursework, spam or unsolicited promotional content, or personal information about a third party shared without their consent.

6. Reporting Violations

If you experience or witness a violation of this AUP, please report it immediately through the Help Desk or by emailing support@akharoub.com. Reports are reviewed by our Trust & Safety team, and we will not disclose your identity as a reporter to the party you reported without your consent, except where required by law.

7. Enforcement

Violations of this AUP may result in content removal, a formal warning, temporary suspension, or permanent termination of your account, at AKHAROUB's discretion and depending on severity, in accordance with Section 9 of our Terms of Service. Serious violations, including threats of violence or illegal activity, may be reported to law enforcement.

2. No Guarantee of Results

Language acquisition depends on many factors outside our control, including your prior language background, the time and consistency you invest, individual aptitude, and life circumstances. AKHAROUB does not guarantee that any student will reach a particular CEFR level, pass any specific proficiency exam (such as DELE, DELF, JLPT, TOPIK or the Goethe-Zertifikat), achieve conversational fluency within a stated timeframe, or obtain any particular professional or academic outcome from using the Services. Any figures shown for typical progress (for example, on our Student Success Stories page) reflect individual results and are not a guarantee of your own results.
